Eve Black went viral arguing with a cop and laughing at a border checkpoint during lockdown. Her court date today was just as bizarre.

Ms Black, whose real name is Eugenia Limberiou, appeared briefly in the Melbourne Magistrates Court on Tuesday.

She was charged in July in Carlton with stating a false name and address, after allegedly being “argumentative” and “uncooperative”, a police summary released by the court alleges.

She was also fined $1652 for breaching COVID-19 restrictions.

Police allegedly smashed her window when she refused to give them information after being pulled over on July 29 last year.

She was pulled out of her car by officers, handcuffed and arrested in Rathdowne Street about a week after the video that made her notorious, a police summary said.

The charge was separate to her actions captured in the viral video, in which the 28-year-old filmed herself arguing with a police officer at a checkpoint in regional Victoria at the height of the COVID-19 lockdown.

An officer is seen in the video allowing Ms Black through despite her refusal to provide her reason for travelling, at a time when Victorians were forbidden from leaving their homes without one of four legitimate excuses.

The footage of Ms Black laughing as she drives through the checkpoint went viral and incited outrage that she seemed to get away with breaking the rules when so many other Victorians were obeying the lockdown.

Ms Black joined the court on Tuesday over videolink from her new home of Brisbane.

She was joined by a friend who identified himself as her legal adviser and went by the name Zev Secured Party Creditor, claiming he had changed his name through "uniform commercial code filings".

He asked the magistrate to discharge the matter because of some "very incorrect filings".

"For a start, Ms Limberiou has been listed as a male, which clearly isn't the case," he said.

"That's the first major error."

He later apologised when a loud squawk interrupted proceedings.

“Sorry, that was my parrot,” he said.

Zev told the court he was “currently not certified as a practitioner” but had a 20-year background as a paralegal.

He asked the court for a “plea of abatement” or for the charges to be dismissed.

However he was told by judicial registrar Alison Paton that term did not exist in modern Victorian law.

“What do you mean by a plea in abatement?” she said.

“That’s not a term that is available in this court.”

He told the judicial registrar it was a term “that’s usually recognised by the courts, particularly at common law where there’s been an error in judicial filing”.

But he was unsuccessful in having the case thrown out.

He also claimed there was “zero evidence” for the charge.

Judicial registrar Paton ordered Ms Black and her representative to undergo a case conference with police as the charges would not be dropped and it appeared Ms Black intended to plead not guilty.

Ms Black posted on her Instagram page in February that she has moved to an orthodox Christian convent to be closer to God.

The matter was adjourned to July 1.
